BrainList Terms of Service
Effective date: May 14, 2026 Last updated: May 14, 2026
These Terms of Service (“Terms”) govern your access to and use of the BrainList mobile app, the BrainList web app at app.brainlist.io, and the BrainList marketing site at brainlist.io (collectively, the “Service”). The Service is operated by Haidar Al-Aubiydy (“BrainList”, “we”, “us”, “our”).
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you have questions, email support@brainlist.io.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Service, and that adult must accept these Terms on your behalf.
The Service is intended for general audiences. We do not knowingly collect data from children under 13. If you believe a child under 13 has registered, email privacy@brainlist.io and we will delete the account.
2. Your account
When you sign up — by email + password, Google, or Apple — you are creating a BrainList account.
You are responsible for:
- keeping your password (or third-party sign-in credentials) secure
- everything that happens under your account, including content you publish and contests you host
- providing accurate information (email, display name) so we can contact you when necessary
You may delete your account at any time from the Settings screen in the mobile app or via the web account-deletion page at app.brainlist.io/account-deletion/. Deletion is permanent and immediate (with the documented exceptions in our Privacy Policy).
We may suspend or terminate your account if we reasonably believe you are violating these Terms, our Community Guidelines, or the law.
3. The Service
BrainList provides original audio learning episodes, quizzes, live multiplayer trivia contests, weekly leagues, and (for paying users) a user-generated content Studio where you can author your own series and questions for others to play.
We may add, remove, or change features at any time. We will give you reasonable notice before removing a feature that materially affects a paid subscription you currently hold.
4. Subscriptions and billing
4.1 Free tier
The Service includes a free tier supported by advertising. Free-tier features include:
- unlimited audio episodes
- unlimited solo quizzes
- 10-player live contests
- Bronze and Silver league participation
Free-tier users see ads at four trigger points: before every episode, after every two solo quizzes, before every 1-on-1 contest, and before every hosted (PIN) contest.
4.2 Paid plans
Paid plans unlock the full feature set (ad-free, 50-player contests, all league tiers, Weekly Trivia Nights, Studio access). Current paid plans:
| Plan | Monthly | Annual |
|---|---|---|
| Solo | $5.99 USD / mo | $49.99 USD / yr |
| Family (up to 4 accounts) | $10.99 USD / mo | $99.99 USD / yr |
Prices are in US dollars unless your store displays them in a local currency. We may change pricing for new subscriptions at any time; existing subscriptions are not affected until renewal.
4.3 Founders’ rate
Users who create an account before November 13, 2026 (the day the paid tier launches) are stamped as “founding members”. When the paid tier opens, founding members are offered a permanent discounted rate (Solo $3.99/mo, Family $79/yr) honored automatically at their first paid checkout. The founders’ rate persists for the life of the account, including across plan changes, as long as the subscription is not cancelled.
4.4 Trials and renewals
If your plan includes a free trial, your payment method will be charged at the end of the trial unless you cancel before the trial ends. All subscriptions renew automatically at the end of each billing period (monthly or annual) for the same plan and price you most recently held.
To cancel:
- iOS: Settings → Apple ID → Subscriptions
- Android: Play Store → Profile → Payments & subscriptions → Subscriptions
- Web (Stripe): Settings → Manage subscription in the BrainList web app
Cancellations take effect at the end of the current billing period. You keep paid access until then.
4.5 Refunds
For subscriptions purchased through Apple’s App Store or Google Play, refund requests are handled by the respective store under their refund policies. We do not have the technical ability to issue store-side refunds.
For subscriptions purchased directly through us via Stripe, you may request a refund within 14 days of the initial purchase or renewal by emailing support@brainlist.io. We may decline refunds in cases of suspected abuse.
4.6 Taxes
Prices shown to you may not include applicable taxes (GST/HST/VAT/sales tax). Apple, Google, and Stripe collect the right taxes at checkout based on your billing address.
5. Acceptable use
You agree not to:
- attempt to access, scrape, or reverse-engineer the Service beyond what its public APIs allow
- use the Service to send spam, harass other users, or post content that is illegal, harmful, hateful, deceptive, or infringing
- impersonate another person or misrepresent your affiliation with any person or entity
- circumvent any ad-display, paywall, rate-limit, or moderation system
- upload viruses, malware, or any code designed to disrupt the Service
- use the Service to compete against us or to build a competing product
We may remove content, suspend features, or terminate accounts that we reasonably believe violate this section.
6. Community guidelines
When you participate in live contests, the leaderboard, or social features (friends, follow graph), you agree to:
- treat other users with basic respect
- not post content that contains hate speech, harassment, sexual content involving minors, gratuitous violence, or content that promotes self-harm
- not impersonate other users, BrainList staff, or public figures
- not use bots or automation to inflate your scores, league standing, or follower counts
Repeated violations result in temporary cooldowns or permanent suspension. We err on the side of conservative moderation when content involves minors or self-harm.
7. User-generated content (Studio)
If your subscription includes Studio access, you may author your own series, episodes, and trivia questions for others to play.
7.1 Your content
You retain ownership of the original creative content you create in Studio (your scripts, your trivia prompts, your original cover-image uploads). By submitting content to Studio, you grant BrainList a worldwide, non-exclusive, royalty-free license to host, reproduce, distribute, perform, and display your content within the Service. This license is for the operation and promotion of BrainList only — we do not claim ownership.
The license persists for as long as your content remains published on the Service. You can withdraw it at any time by deleting the content.
7.2 Moderation
All Studio content goes through a moderation review before becoming publicly playable. We reserve the right to:
- reject content that violates these Terms, our Community Guidelines, or the law
- suspend an author’s Studio access after 3 rejections (14-day cooldown)
- permanently revoke Studio access after 5 rejections or any single severe violation
Approved content appears with a “Community” badge so other users can identify user-generated material.
7.3 Warranties about your content
You warrant that:
- you own or have a license to use everything you upload (scripts, images, audio)
- your content does not infringe anyone else’s copyright, trademark, privacy, or publicity rights
- your content complies with these Terms and our Community Guidelines
You are responsible for any consequences arising from content you upload.
7.4 Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice that meets 17 U.S.C. § 512(c)(3) to dmca@brainlist.io. Include:
- the work you claim has been infringed
- the URL of the infringing content on the Service
- your contact information
- a statement under penalty of perjury that you are authorized to act for the rights-holder
We respond to valid DMCA notices within a reasonable time.
8. Intellectual property
The Service, including all original audio episodes, illustrations, software, branding, and design, is the property of BrainList or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers that ownership to you.
You receive only a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
9. Third-party services
The Service relies on third-party providers for parts of its functionality:
- Apple App Store and Google Play for mobile subscriptions
- Stripe for web subscriptions
- RevenueCat for cross-platform subscription state
- AdMob (Google) for advertising on the free tier
- Firebase Cloud Messaging for push notifications
- Amazon Web Services / Wasabi for media storage
- Google Cloud / Anthropic / OpenAI for the AI content production pipeline
- PostHog for product analytics
- Sentry for crash reporting
Their use of any data we share with them is governed by their respective terms and privacy policies. See our Privacy Policy for more detail.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE EDUCATIONAL CONTENT IS COMPLETE, CURRENT, OR FREE OF FACTUAL ERROR. THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE (MEDICAL, LEGAL, FINANCIAL, ETC.).
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- BRAINLIST’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100
- BRAINLIST IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL
- BRAINLIST IS NOT LIABLE FOR CONTENT POSTED BY OTHER USERS, INCLUDING USER-GENERATED STUDIO CONTENT
Some jurisdictions do not allow the limitations above. In those jurisdictions, our liability is limited to the extent permitted by local law.
12. Indemnification
You agree to defend, indemnify, and hold harmless BrainList and its officers, agents, and licensors from any claim, liability, damage, or expense (including reasonable legal fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) content you submit to the Service, or (d) your violation of any third party’s rights.
13. Termination
These Terms continue until you stop using the Service or until your account is closed. We may terminate or suspend your access at any time, with or without notice, if we reasonably believe you have violated these Terms.
On termination, sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive.
14. Changes to these Terms
We may update these Terms from time to time. We will:
- post the updated Terms at this URL with a new Effective date
- for material changes, give you notice by email or in-app banner at least 14 days before the changes take effect
- treat your continued use of the Service after the new effective date as acceptance of the updated Terms
If you do not agree to a material change, your remedy is to stop using the Service and (for paid subscriptions) cancel before the change takes effect.
15. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to its conflict-of-laws rules. The exclusive jurisdiction for any dispute is the courts of Ontario, Canada, except where local consumer-protection law gives you a non-waivable right to sue in your home jurisdiction.
If you have a complaint, we encourage you to email support@brainlist.io first — most disputes resolve informally.
16. Miscellaneous
- Entire agreement. These Terms (together with our Privacy Policy and any plan-specific terms you accept at checkout) are the entire agreement between you and BrainList about the Service.
- No waiver. Our failure to enforce a provision is not a waiver of that provision.
- Severability. If any provision is found unenforceable, the rest remain in effect.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No agency. No partnership, employment, agency, or joint venture is created between you and BrainList by these Terms.
- Contact. Email support@brainlist.io for any question about these Terms. Email privacy@brainlist.io for data-protection requests. Email dmca@brainlist.io for copyright notices.
